Welcome to SpeakBold. These Terms of Service ("Terms") govern your access to and use of the SpeakBold mobile application and related services (collectively, the "Service") provided by SpeakBold ("we", "us", or "our"). Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By downloading, installing, or using SpeakBold, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

You must be at least 13 years old (or the applicable age of digital consent in your jurisdiction) to use SpeakBold. By using the Service, you represent that you meet this age requirement.

2. Description of Service

SpeakBold is an AI-powered expression training application that provides:

  • AI-driven scenario-based speaking practice with real-time voice interaction
  • Professional expression framework training (STAR, PREP, FAB, AIDA, SBI, DESC, GROW, and more)
  • Multi-dimensional AI assessment and scoring of your speaking performance
  • Personalized learning paths and training recommendations
  • Progress tracking, achievements, and streak systems

3. Account Registration

  • You must create an account to access certain features of the Service
  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to provide accurate, current, and complete information during registration
  • You are responsible for all activity that occurs under your account

4. Subscription & Payments

4.1 Free Plan (Starter)

  • The Starter plan provides access to basic training scenarios, 3 expression frameworks, and basic AI feedback at no cost
  • We reserve the right to modify the features included in the free plan at any time

4.2 Pro Plan

  • The Pro plan is available as a monthly subscription at the price displayed at the time of purchase
  • Subscriptions are billed through the Apple App Store or Google Play Store and are subject to their respective terms
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • You can manage and cancel your subscription through your device's app store settings

4.3 Refunds

Refund requests are handled by the Apple App Store or Google Play Store in accordance with their refund policies. SpeakBold does not directly process refunds for in-app purchases.

5. User Conduct

You agree not to:

  • Use the Service for any illegal, harmful, or unauthorized purpose
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to harass, abuse, or harm others, or to transmit offensive, abusive, or inappropriate content
  • Interfere with or disrupt the Service's infrastructure, servers, or networks
  • Create multiple accounts for fraudulent purposes or to circumvent restrictions
  • Use automated scripts, bots, or scrapers to access the Service

6. Intellectual Property

All rights in the Service are owned by or licensed to SpeakBold:

  • The SpeakBold name, logo, branding, and all content including expression frameworks, training materials, AI models, and scoring algorithms are our intellectual property
  • You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes
  • You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent

7. User Content

When you use SpeakBold, you create content such as voice recordings, custom scenarios, and training data:

  • You retain ownership of your original content (e.g., custom scenarios you create)
  • Your voice recordings and content are processed solely to provide the Service to you (AI analysis, feedback, and progress tracking). We do not claim any rights, ownership, or license to your content. We will never use your content for training, analytics, marketing, or share it with third parties for any purpose beyond delivering the service.
  • You are responsible for ensuring your content does not violate any third-party rights or applicable laws

8. AI-Generated Content Disclaimer

SpeakBold uses artificial intelligence to provide coaching, feedback, and assessment:

  • AI-generated feedback, scores, and recommendations are provided for educational and training purposes only and should not be considered professional advice
  • AI assessments may not be perfectly accurate and should be used as a guide for improvement, not as definitive evaluations
  • We continuously work to improve our AI, but we do not guarantee the accuracy, completeness, or reliability of AI-generated content

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPEAKBOLD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to SpeakBold in the 12 months preceding the claim, or $100, whichever is greater.

10. Disclaimers

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied
  • SpeakBold is an expression training tool and does not guarantee any specific professional, career, or communication outcomes
  • We do not guarantee uninterrupted, error-free, or secure access to the Service at all times

11. Termination

Either party may terminate this agreement:

  • You may delete your account at any time through the app settings
  • We may suspend or terminate your access if you violate these Terms or engage in conduct that we reasonably determine is harmful to other users or the Service
  • Upon termination, your right to use the Service ceases, and we may delete your data in accordance with our Privacy Policy

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SpeakBold is incorporated, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or via email. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of those changes.
